Terms and Conditions

By booking and paying for a session with SøulBody Massage, you confirm that you have read and agree to the terms below. These terms apply to your booking, your session, and any pre-paid package or gift voucher.

1. About these terms 

1.1  These Terms govern your booking and use of services with SøulBody Massage (referred to as "we", "us", or "the Practitioner"), operated by Eugenia Sal from Brisbane, Queensland. 

1.2  By booking, paying for, or attending a session, you ("the Client") agree to these Terms in full. 

2. Bookings and payment 

2.1  Bookings are made through our website or booking system. A deposit is required at the time of booking to secure your appointment, in accordance with our cancellation policy in clause 3. 

2.2  The remaining balance of the session fee is due in full at the time of service. Prices are in Australian dollars and include GST where applicable. 

3. Cancellation, rescheduling, and late arrival 

3.1  Booking deposits. To secure your appointment, the following deposit is required at the time of booking: 

(a)  First-time clients: the full session fee, paid as a deposit and credited toward your service upon attendance. 

(b)  Returning clients (clients who have attended at least one previous session): a booking fee of $30 AUD, credited toward your full session fee upon attendance. 

3.2  More than 24 hours before the appointment. Where you cancel or reschedule more than 24 hours before your scheduled appointment, your deposit or booking fee will be refunded in full, or transferred to your new appointment, at your election. 

3.3  Within 24 hours of the appointment. Where you cancel or reschedule within 24 hours of your scheduled appointment, a cancellation fee of $30 AUD will be charged or retained from your deposit. Any remaining balance of your deposit will be refunded. 

3.4  No-shows. Failure to attend your appointment without notice (a "no-show") results in the forfeiture of your full deposit or booking fee. No-show fees are strictly non-refundable. 

3.5  Late arrivals. Arrival more than 15 minutes after your scheduled start time may result in a shortened session, or in the cancellation of the session at our discretion. Where the session cannot proceed, the $30 cancellation fee will apply. 

3.6  Exceptional circumstances. We understand that emergencies and serious illness occur. We may waive cancellation fees at our sole discretion in genuine and exceptional circumstances. 

4. Health disclosure 

4.1  You must complete our intake form before your first appointment, and disclose any new injuries, illnesses, medications, allergies, or pregnancy at every subsequent booking. 

4.2  You are responsible for providing accurate and complete health information. Where you have failed to disclose a relevant matter and an adverse outcome occurs as a result, you accept full responsibility for that outcome to the extent permitted by law. 

4.3  We reserve the right to decline, modify, or shorten a treatment based on health information disclosed, and may require written clearance from your medical practitioner before proceeding in some cases. 

5. Nature of services 

5.1  SøulBody Massage is a professional therapeutic practice. All services are clinical and therapeutic in nature, intended to support physical wellbeing and recovery. 

5.2  All services are strictly professional and non-sexual. Any sexual conduct, comments, suggestions, advances, or implications from a Client are absolutely prohibited.

5.3  The Practitioner reserves the right to immediately terminate any session, without refund, in response to: 

(a)  any inappropriate conduct, language, gesture, or advance; 

(b)  any conduct that makes the Practitioner feel unsafe, uncomfortable, or disrespected; 

(c)  any other breach of these Terms. 

5.4  Such conduct may be reported to the Queensland Police Service and to relevant professional associations. SøulBody Massage reserves the right to refuse future bookings from any Client who has breached this clause, indefinitely and without obligation to provide a reason. 

6. Code of conduct 

6.1  We are committed to providing a safe, calm, and respectful environment. We expect the same in return. 

6.2  During your visit you agree to: 

(a)  treat the Practitioner with courtesy and respect at all times; 

(b)  communicate openly about your comfort during the session; 

(c)  refrain from attending under the influence of alcohol or non-prescribed drugs; 

(d)  refrain from photography, audio, or video recording within the treatment space at any time; 

(e)  maintain appropriate personal hygiene before your session; 

(f)  advise us in advance if you are unwell, and reschedule where appropriate. 

7. Treatment outcomes and liability 

7.1  Massage therapy can support a range of physical and emotional wellbeing outcomes, however no specific therapeutic result can be guaranteed. Outcomes vary between individuals. 

7.2  We perform all services with the reasonable care and skill expected of a qualified massage therapist. You acknowledge that bodywork carries inherent risks, including but not limited to temporary muscle soreness, fatigue, tenderness, bruising in rare cases, and emotional release. 

7.3  Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that you have under the Australian Consumer Law and that cannot be lawfully excluded. 

8. Gift vouchers and packages 

8.1  Gift vouchers are valid for three (3) years from the date of issue, in accordance with the Australian Consumer Law. They are not redeemable for cash and are non-refundable except as required by law. 

8.2  Pre-paid packages must be used within twelve (12) months from the date of purchase unless otherwise agreed in writing. Packages are non-transferable and non-refundable except as required by law. 

8.3  In exceptional circumstances such as serious illness, injury, or pregnancy, we may extend the validity of a voucher or package at our sole discretion. 

9. Privacy 

9.1  We handle your personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Information is kept confidential and used only for the purposes for which it was collected.

10. Refunds 

10.1  We do not offer refunds for completed services delivered to a reasonable standard. Where you believe a service was not delivered to a reasonable standard, please raise your concerns in writing within seven (7) days of the session and we will work in good faith to resolve the matter. 

10.2  Your rights under the Australian Consumer Law are not affected by this clause. 

11. Governing law 

11.1  These Terms are governed by the laws of the State of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland, unless otherwise required by law. 

11.2  If a dispute arises, both parties agree to attempt to resolve it in good faith through direct communication before pursuing formal legal action.
